Terms of use

These Terms of use (“Terms”) set out the conditions of access to and use of the iris-prevention.fr website (the “Website”) and the Iris health prevention platform available to beneficiaries through a secure personal account (the “Platform”), together the “Service”.

The Service is published by France Surgery, SAS with share capital of €43,780, RCS Toulouse 515 151 835, registered office at 11 rue Saint-Expédit, 31500 Toulouse, France (“France Surgery” or “we”).

“Client” means the company, insurer or any legal entity that has entered into a contract with France Surgery to make the Service available to its employees or members.

“Beneficiary” means the natural person, employee or member of a Client, who has access to the Platform.

“User” means any person who browses the Website or uses the Platform, whether a Beneficiary or a simple visitor.

“Partner healthcare professional” means the independent doctors, centres and practitioners to whom France Surgery may refer the Beneficiary as part of a prevention check-up.

Browsing the Website constitutes acceptance of these Terms. Access to the Platform requires their express acceptance when the personal account is created. Any User who does not accept the Terms must refrain from using the Service.

France Surgery may amend the Terms at any time, in particular to reflect legal, technical or functional changes. The applicable version is the one published on the Website; Beneficiaries are informed of any substantial change at their next login.

The Website presents the Iris offer, publishes health prevention content (La Gazette) and lets you contact us or request a demo.

As part of the prevention campaigns organised on behalf of their Client, the Platform enables Beneficiaries to:

• complete health prevention questionnaires and receive personalised scores and recommendations;

• compare their results with previous assessments;

• access tailored prevention content;

• where applicable, be referred to a Partner healthcare professional and book an appointment for a check-up (online booking tool);

• manage their personal account and their data.

The exact scope of features depends on the contract entered into with each Client.

The Service is a health prevention and information tool. It is not a medical consultation, diagnosis, prescription or medical follow-up. The scores, recommendations and content provided are based on the answers declared by the Beneficiary and on recognised scientific references; they never replace the advice of a healthcare professional.

France Surgery organises the prevention pathway but performs no medical act: the acts, examinations and advice provided by Partner healthcare professionals are their sole responsibility and subject to their own professional ethics.

The Service is not an emergency service. In a medical emergency, immediately call 15 (SAMU, France) or 112.

The Website is freely accessible to any User with an internet connection. The Platform is reserved for adult Beneficiaries invited by a Client; the Service is not intended for minors.

Access to the Platform is free of charge for the Beneficiary, as the Service is funded by the Client. Participation in prevention campaigns is free and voluntary: the Beneficiary may decline to take part or stop a check-up at any time without justification, and with no consequence for their relationship with their employer or organisation.

France Surgery uses reasonable means to ensure access to the Service 24/7, without any guarantee of result. Access may be suspended for maintenance, updates or any security reason, without giving rise to compensation.

The personal account is created from information provided by the Client or entered by the Beneficiary, who undertakes to provide accurate information and keep it up to date.

Credentials are strictly personal and confidential. The Beneficiary is responsible for keeping them safe and for any use made of their account. They undertake to choose a strong password, never to share it, and to inform France Surgery without delay at contact@iris-prevention.fr in the event of loss, theft or unauthorised use. Strong authentication (two-factor) may be required.

The User undertakes to use the Service in accordance with its purpose, these Terms and applicable law. In particular, the User must not:

• knowingly provide false information or impersonate a third party;

• access or attempt to access data or accounts that do not belong to them;

• hinder or disrupt the operation of the Service (intrusion, injection, overloading, scraping, reverse engineering);

• reproduce, extract or reuse the Service's content, questionnaires and algorithms for anything other than personal use;

• post or transmit unlawful, abusive content or content infringing third-party rights.

Any breach may lead to suspension or termination of access, without prejudice to claims for damages.

Using the Platform involves the processing of personal data, including health data. This processing is carried out by France Surgery as data controller (or, where the contract with the Client so provides, as processor on behalf of the Client), in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act.

Health data is processed only with the Beneficiary's explicit consent, collected before each check-up, and hosted in France by a certified Health Data Hosting (HDS) provider. It is never disclosed to the Client or insurer in a form that could identify the Beneficiary: they receive only aggregated, anonymised indicators, computed only when at least 30 respondents contribute to each indicator. Beneficiaries may object to the reuse of their answers for statistical purposes by writing to dpo@iris-prevention.fr.

The Service and all its components (texts, articles, questionnaires, scoring methods, graphics, logos, trademarks, software, databases) are protected by intellectual property law and belong to France Surgery or its partners.

France Surgery grants the User a personal, non-exclusive, non-transferable right to access and use the Service for the duration of their use. Any other use, reproduction or distribution is prohibited without prior written consent.

Results and documents generated for a Beneficiary are intended for them and may be freely downloaded and shared by them, in particular with their doctor.

France Surgery undertakes to provide the Service diligently and in line with best practice, on a best-efforts basis. France Surgery shall not be liable:

• for inaccurate or incomplete information declared by the Beneficiary in the questionnaires;

• for the acts, diagnoses and advice of Partner healthcare professionals;

• for unavailability of the Service due to maintenance, force majeure, internet network failure or the User's equipment;

• for the content of third-party websites accessible via hyperlinks;

• for any use of the Service that does not comply with these Terms.

The User is solely responsible for decisions made on the basis of information provided by the Service, which they are encouraged to discuss with a healthcare professional.

The Terms apply for the entire duration of use of the Service. Beneficiaries may stop using the Platform at any time and request deletion of their personal account at dpo@iris-prevention.fr.

Access to the Platform ends automatically upon expiry of the contract with the Client or when the Beneficiary no longer belongs to that Client. France Surgery may also suspend or terminate access in the event of a breach of these Terms, a security risk to the Service, or a request from a competent authority. Data is then retained and deleted in accordance with the periods stated on the “Secure data” page.

Where the prevention pathway provides for it, the Beneficiary may book an appointment with a Partner healthcare professional through an online booking tool integrated into the Platform. Booking is optional. The Beneficiary remains free to choose their practitioner and may, if they prefer, consult the healthcare professional of their choice outside the Service.

The care relationship established with the Partner healthcare professional is exclusively theirs; they create and keep the medical record in accordance with their legal and ethical obligations. France Surgery provides no medical follow-up.

If any provision of the Terms is held to be invalid or unenforceable, the remaining provisions shall remain fully valid. France Surgery's failure to enforce a breach shall not constitute a waiver of the right to enforce it later.

The Terms are drafted in French; in the event of any discrepancy with a translated version, the French version shall prevail.

These Terms are governed by French law.

In the event of a problem, the User is invited to contact France Surgery first at contact@iris-prevention.fr or by post at the registered office, in order to seek an amicable solution. In accordance with Articles L.611-1 et seq. of the French Consumer Code, consumer Users may have free recourse to a consumer mediator.

Failing an amicable resolution, any dispute shall be brought before the competent French courts.
